These Terms of Service ("Terms") govern your access to and use of the Nirvan website (https://nirvan.app) and the Nirvan macOS application (collectively, the "Services"), provided by Pawel Borkar ("we", "us", or "our").

Please read these Terms carefully before using the Services.

1. Acceptance of Terms

By downloading, installing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services. By agreeing to these Terms, you represent and warrant that you meet this age requirement.

3. License to Use

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Nirvan software on macOS devices that you own or control. This license is subject to the specific restrictions outlined in ourEnd User License Agreement (EULA).

4. Acceptable Use & Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Copying, modifying, or creating derivative works of the Services.
  • Reverse engineering, decompiling, or disassembling the software.
  • Using the Services for any illegal or unauthorized purpose.
  • Interfering with or disrupting the integrity or performance of the Services.
  • Attempting to bypass any licensing restrictions or software protections.

5. Intellectual Property Rights

All rights, title, and interest in and to the Services (including but not limited to the source code, design, UI/UX, and trademarks) are and will remain the exclusive property of Pawel Borkar. Nothing in these Terms gives you a right to use the Nirvan name, logos, or domain names.

6. Billing & Payments

We offer various pricing tiers, including a Free tier, Pro tier (one-time payment with 1 year of updates), Lifetime tier, and Team tier.

  • Payments: All payments are processed securely via our third-party payment processors. You agree to provide accurate and complete billing information.
  • Taxes: Prices listed may be exclusive of applicable taxes. You are responsible for any applicable taxes.
  • Refunds: We offer a 30-Day Money-Back Guarantee. Please refer to our Refund Policy for full details.

7. Updates & Maintenance

The duration for which you receive updates depends on your purchased tier:

  • Pro Tier: Includes major and minor software updates for 1 year from the date of purchase.
  • Lifetime Tier: Includes all future major and minor updates indefinitely.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time.

8. Suspension & Termination

We may terminate or suspend your license and access to the Services immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

9. Warranty Disclaimer

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PAWEL BORKAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; OR (B) ANY UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
